Business Contract Disputes

Watson Legal appreciates that any form of a dispute costs businesses time and money. We aim to help in resolving business disputes in a cost effective and timely fashion. We can do as little or as much as you require us to do.

We have experience in the Magistrates Court, County Court, High Court and Court of Appeal. Whatever subject matter the contractual dispute relates to, Watson Legal will advise so that you can make an informed decision on how to proceed.

Debt Recovery

Whatever the size of your business, profitability and cash flow can be badly affected by bad debts. At Watson Legal we specialise in debt recovery to improve your cash flow. We offer fixed fees for chasing of outstanding payments, whatever the sum and proceedings through the small claims track (subject to initial assessment).

Alternatively you may have had a judgment against the business, we can also assist in this scenario. There are certain situations where a judgment can be set aside. There are strict time limits to such applications and therefore imperative to seek legal advice immediately upon receipt.

An average fee for a debt recovery claim which is disputed is in the region of £10,000. This fee is subject to VAT and disbursements.

Disbursements are costs payable to another organisation which are incurred by us as agency for you.

The fee quoted is based on a straight forward claim which includes the following stages:

Stage 1 – Preparing letter of claim

Stage 2 – Preparing Claim Form with Particulars of Claim being issued at the court and served on the Defendant by the court or reviewing documents if acting for the Defendant

Stage 3 – Considering Defence or preparing Defence if acting for the Defendant

Stage 4 – Completion of Directions Questionnaire and Costs Budget if Multi-track case

Stage 5 – Preparing for and attending Case Management Conference at Court

Stage 6 – Undertaking standard disclosure including preparing list and issuing documents to the Defendant or their legal representative

Stage 7 – Preparing witness statements

Stage 8 – Completing pre-trial checklist

Stage 9 – Instructing Counsel to attend trial

Stage 10 – Attending court for trial alongside Counsel

The fee quoted therefore only includes two attendances at court; one Case Management Conference and the trial. The Case Management Conference being completed in no more than 2 hours from the point of arriving at court. The trial being no longer than one day. The fees quoted do not include any supplemental hearings for additional applications within the proceedings.

The fee quoted does include correspondence with you, the court, the other side’s representative and instructing Counsel.

The fee quoted are based on a maximum of 6 hours spent on disclosure.

The fee quoted only include the preparation of two witness statements with exhibits but on the basis each witness statement takes no more than 4 hours including attendances upon you on to approve and sign the statements.

The fee quoted are based on both parties having legal representation.

The lower of the band is based on 42 hours at Sarah Watson’s standard hourly rate of £240.00 plus VAT. This is with a limitation of 2 hours of correspondence and 3 hours additional attendances.

The fee indicated is an average fee and is unlikely to be the precise amount you will pay.

Please note that the fees quoted do not include expert fees.

The total average cost is therefore £26,037.80 including VAT and disbursements based on a £100,000 value claim.
